1. About these Terms
These Terms and Conditions apply to your access to and use of the Padayon Capital website, communications, enquiry forms and credit-assistance services (Services). By using our website, providing information to us, or asking us to provide Services, you agree to these Terms. If you do not agree, please do not use the website or provide us with information.
Padayon Capital Pty Ltd trading as Padayon Capital is an Authorised Credit Representative of Fintelligence Pty Ltd. Credit services are provided under the Australian Credit Licence of Fintelligence Pty Ltd (ACL 511803).
2. Our role and scope of services
We provide credit assistance, which may include discussing your finance needs, collecting information, considering available finance options, assisting with a credit application, and liaising with credit providers, suppliers and other parties involved in a proposed transaction.
We are not a lender, insurer, legal adviser, accountant, tax adviser or financial adviser unless we expressly agree otherwise in writing. We do not make the credit decision and cannot guarantee that a credit provider will approve an application, offer a particular interest rate, term, repayment, product feature, or settle a transaction.
3. No guarantee or commitment
Information on our website and in our communications is general in nature and is not a promise, offer or commitment to provide credit. Any indication, estimate, repayment example, pre-qualification, conditional approval or discussion of likely terms is subject to verification, the relevant credit provider's policies, formal assessment, documentation and final approval.
A credit provider may change, withdraw or impose conditions on an approval at any time before settlement. You should not enter into an unconditional purchase contract, incur expenses, or rely on finance being available until you have received and accepted formal approval and are satisfied with the relevant transaction documents.
4. Your responsibilities
You must provide information and documents that are complete, accurate, current and not misleading. This includes information about your identity, income, business, assets, liabilities, expenses, credit history, proposed asset and any guarantor. You must promptly tell us if information changes or if you become aware of an error.
You authorise us to rely on information you provide, subject to our obligations at law. Providing false, incomplete or misleading information may prevent us from assisting you, result in an application being declined, or have legal consequences. You are responsible for obtaining your own legal, tax, accounting and financial advice before entering a finance transaction.
5. Privacy, consent and electronic communications
Our collection, use, storage and disclosure of personal information and credit information is governed by the Privacy Consent and applicable Privacy Policy provided to you or available on request. Where required, we will obtain your consent before making credit enquiries, obtaining credit reports, verifying information or disclosing information to credit providers and other relevant parties.
If you provide an email address or mobile number, you consent to receiving notices, disclosures and documents electronically where permitted by law. You are responsible for maintaining access to the nominated electronic communication method and for promptly notifying us of any change. You may withdraw consent to electronic communications by contacting us, subject to any legal requirement to receive documents electronically or in another form.
6. Fees, charges and commissions
We may receive commission from a credit provider if a loan or lease settles. We may also pay a commission or referral payment to an eligible referrer where permitted by law and disclosed as required. Details of relevant commissions and benefits will be disclosed in the applicable Credit Proposal or other disclosure document before you proceed.
We may charge a fee for our Services only where the fee has been disclosed to you and agreed by you in writing before it becomes payable. Any fee, its amount, timing, method of payment and refund treatment will be set out in the relevant Credit Guide, Credit Proposal, engagement document or other written agreement. Third-party fees, including credit-provider, registration, valuation, inspection, supplier or insurer fees, may also apply and will be disclosed where known or applicable.
7. Credit documents and decisions
Before entering a credit contract or lease, carefully read all documents provided by the credit provider and any supplier. These documents may include interest, repayments, fees, security, guarantees, events of default, insurance requirements, residual value, early payout costs and other obligations. The credit provider's documents govern the credit product; if there is any inconsistency between these Terms and a credit provider's documents, the credit provider's documents prevail in relation to that credit product.
You are not required to accept a product we suggest. You should ask questions if you do not understand a term, cost or risk.
8. Website information and third parties
Website content is provided for general information only and may change without notice. We take reasonable care in preparing it but do not warrant that it is complete, current, error-free, suitable for your circumstances or continuously available.
Our website or communications may contain links to third-party websites or refer to third-party products and services. Those sites and parties are not controlled by us. A link or reference does not mean we endorse them, and we are not responsible for their content, availability, privacy practices, products, services, acts or omissions.
9. Intellectual property and permitted use
Unless otherwise stated, the content, branding, logos, text, design and materials on our website are owned by or licensed to Padayon Capital. You may view and print website material for your personal or internal business use only. You must not copy, reproduce, adapt, distribute, publish, sell, reverse engineer, scrape or commercially exploit any material without our prior written consent, except where permitted by law.
10. Liability
To the maximum extent permitted by law, we exclude liability for loss arising from your use of our website, reliance on general information, delays, third-party acts or omissions, a credit provider's decision, or a transaction that does not proceed. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.
Where liability cannot lawfully be excluded but may be limited, our liability is limited to the extent permitted by law. You remain responsible for your decisions, including whether to apply for or enter into a credit contract or lease.

Please provide enough detail for us to investigate and respond. If you are not satisfied with our response, you may be able to refer the matter to the Australian Financial Complaints Authority (AFCA), a free and independent external dispute-resolution service. AFCA can be contacted on 1800 931 678, by post at GPO Box 3, Melbourne VIC 3001, or through www.afca.org.au. Our Credit Guide contains further complaints information.
12. Changes to these Terms
We may amend these Terms from time to time by publishing an updated version on our website. The version applying to website use is the version published at the time of use. Changes will not retrospectively alter terms that have already been agreed in a signed Credit Proposal, fee agreement, credit contract, lease or other transaction document.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
